В РФ нависла угроза над очередным Интернет-ресурсом. На этот раз речь идёт о крупнейшей в мире деловой соцсети LinkedIn. Она была основана в 2003 году в Калифорнии. Главное предназначение мессенджера – поиск и установление деловых контактов. В нашей стране LinkedIn за глаза называют «соцсетью для карьеристов». Эта функция облегчалась охватом – более 400 млн пользователей из 200 стран. В общем, котята и прочие цветочки там не приветствуются. Как, впрочем, и «разжигательные» призывы. Не такое у аудитории LinkedIn воспитание. Казалось бы, кому может помешать такой ресурс?
Однако претензии есть – у Роскомнадзора, который утверждает, что LinkedIn нарушает закон «О персональных данных». Соответствующие серверы не перенесены в Россию. К тому же ведётся сбор и передача информации о гражданах, не являющихся пользователями сети, без согласия последних. За такое могут и полноценно блокировать. Первый шаг на этом пути сделан ещё 4 августа: Таганский суд Москвы удовлетворил требования Роскомнадзора, обязав службу принять меры к ограничению доступа к сайту.
Дело идёт к блоикрованию доступа на всей территории РФ.Ресурс должны внести в реестр нарушителей прав субъектов персональных данных. Правда, судебные тяжбы продолжаются. Теперь в Мосгорсуде, где 10 ноября должно состояться вроде бы окончательное заседание. Однако перспективы не утешают – LinkedIn систематически игнорирует запросы Роскомнадзора. И мы прекрасно понимаем, какой получается негативный бэкграунд. Так что сайт может получить незавидную пальму первенства среди себе подобных. Пока что до таких глобальных санкций не доходило.
Конечно, шансы у ресурса остаются. Например, в иске Роскомнадзора указано, что сбор и передача данных российских граждан, в том числе без их согласия (для лиц, не являющихся пользователями LinkedIn), нарушает права и свободы человека и гражданина. Особенно право на неприкосновенность частной жизни, личную и семейную тайну. Как известно, что права и свободы человека в современной РФ – превыше всего. Однако в открытых источниках ничего не говорится о конкретных инициаторах этих претензий. Мы не видим физических или юридических лиц, чьи права ущемляет LinkedIn. И получается, что Роскомнадзор бьется за интересы абстрактного круга потерпевших. Которые даже не подозревают, что таковыми являются.
Конечно, есть закон о персональных данных, вступивший в силу 1 сентября 2015 года. Он включает положение о локализации хранения персональных данных российских пользователей на серверах, расположенных в РФ. Правда, эксперты уже давно бьются над поиском ответа на простейший вопрос: «Какое дело международной компании со штаб-квартирой за пределами территории РФ до российского законодательства?» Власти отвечают в том духе, что «закон суров, но это закон». Заинтересованная публика выступает в ином плане: «Лично мне нет никакого дела, где хранятся мои персональные данные. В эпоху глобализации всё равно ничего не скроешь. Да мне скрывать и нечего!»
Никакие социальные ролики с рушащимися стенами и злодеями в балаклавах, которые воруют ваш нуотбук, здесь не помогут. Более того – некоторые исследования показывают, что многие россияне, напротив, предпочли бы хранить свои данные где угодно, лишь бы не на родине. И их позиция, увы, сейчас вполне объяснима.
Что касается работы с LinkedIn, то у автора в этом плане есть и личный опыт. Например, из-за многоступенчатой системы контроля безопасности пользователю практически невозможно восстановить свой пароль для доступа к соцсети. И это даёт серьёзные гарантии, что нежелательное лицо не проникнет на вашу страничку.
Есть во всей этой истории и ещё один тревожный нюанс. В LinkedIn в числе прочего идёт активный обмен научной информацией – статьями, аналитическими обзорами, просто идеями и мнениями. Кое-кому это явно не нравится. Преподаватели петербургского Военмеха Святослав Бобышев и Евгений Афанасьев уже получили 12,5 и 12 лет колонии за «передачу Китаю секретных сведений по ракетной системе «Булава». Та история, на предварительном этапе весьма противоречивая, закончилась вполне предсказуемо. Теперь во многих вузах возрождаются «первые отделы», фильтрующие научные публикации. Ученые тихо матерятся, но сделать ничего не могут. И блокировка LinkedIn в данном случае окажется явно в строку.
Если мы посчитаем, что первопричина – в покупке ресурса компанией Microsoft за солидные $26,2 млрд, то совсем запутаемся. В целом же имеем тренд. Несмотря на сервильность нынешнего руководства, грядёт тотальная проверка «ВКонтакте». Не закончились трения вокруг Facebook и Twitter, которые пока не горят желанием переносить свои базы в РФ. Поговаривают, что Apple и Google в этом вопросе уже сдались. Госслужащих изолируют от привычных мировых ресурсов, подсовывая взамен местные поделки. По логике вещей, закончится всё отключением россиян от всемирной паутины. Как это в фильме «Стиляги»? «В нашей стране саксофон приравнен к холодному оружию!»
