Застройщик исторической зоны Александрино на юго-западе города проиграл градозащитникам один из самых важных судов. Эта победа активистов, которая в их реестре значится под номером 13, весома не только из-за суммы иска. Хотя требуемая в рамках процесса денежная компенсация, по меркам рядовых граждан, была и впрямь внушительна: 2 миллиона рублей (столько считающие себя пострадавшими коммерсанты намеревались взыскать с ответчиков — одного гражданского активиста и двух институтов). Арбитражный суд Петербурга и Ленобласти, оставив претензии инициаторов процесса без удовлетворения, тем самым закрыл и вопрос об уголовном преследовании одного из защитников Александрино.
Исковое заявление было подписано миллионером Олегом Глущенко, директором фирмы ООО «Воин-В». Эта фирма в течение ряда лет на фоне перманентного градостроительного конфликта осуществляет программу реновации кварталов Ульянки, примыкающих к объекту культурного наследия федерального значения парку и усадьбе Александрино, и интенсивно судится с местными жителями. Только на этот раз в суде Глущенко выступил в качестве председателя ЖК «Стройэкипаж», структуры, аффилированной с «Воин-В». С активиста градозащитной группы ЭРА Николая Лаврентьева и двух институтов (Института географических информационных технологий и Института территориального развития) требовали возмещения ущерба за «нарушение права на результат интеллектуальной деятельности».
«Украденными» у себя «Стройэкипаж» считал фрагменты проектной документации на строительство двух жилых домов в Ульянке. При этом фрагменты, о которых шла речь, были получены из публичного источника — Информационной системы обеспечения градостроительной деятельности Санкт-Петербурга. Использовались они исключительно для подготовки демонстрационных материалов и были представлены в судебных процессах, где активисты выступали заявителями. Что никак не является практической реализацией проекта. Не говоря о том, что законность данного строительства многократно оспорена в судах.
В свете разгоревшегося скандала вокруг двух миллионов правоохранительными и надзорными органами Кировского района продолжал муссироваться вопрос о возбуждении уголовного дела в отношении активиста группы ЭРА Николая Лаврентьева. Всё по тому же поводу – якобы нарушенных авторских прав. Если бы суд решил дело в пользу истца, защитник Александрино оказался бы фигурантом уголовного преследования.
Между тем ещё в начале декабря 2014 года градозащитниками были обнародованы факты предположительной коррупции в отношении руководителей УМВД по Кировскому району северной столицы. В частности, согласно имеющимся документам, двое высокопоставленных полицейских чинов инвестировали средства в строительство одного из спорных домов «Воин-В». И, соответственно планировали получить там квартиры. Странно, если бы в этих обстоятельствах стражи порядка были заинтересованы в том, чтобы бунтовщики – жители Ульянки одержали верх и заблокировали проект. Поэтому неудивительно, что практически на все жалобы по поводу многочисленных нарушений в ходе строительства из УМВД приходили стандартные ответы: «нарушений нет».
Надо сказать, что, когда градозащитники обратились за помощью к депутатам, лидерам общественных движений, оппозиционным журналистам, дабы предать эту информацию максимальной огласке, те испугались и тему проигнорировали. Однако, когда, спустя время, эти факты, назвав их «конфликтом интересов», официально подтвердила городская прокуратура, помощников появилось хоть отбавляй. Словно кто-то дал отмашку.
Гневные публикации посыпались, как горох из прорванного мешка. Народные избранники кинулись выступать с пламенными речами. Некоторые из них не постеснялись приписать изобличение полицейских-инвесторов себе.
Правда, до сих пор не получила широкого распространения другая знаковая информация. В самом конце 2014 года, чуть ли не под бой курантов, «Воин-В» предусмотрительно вывел все свои активы, включая земельные участки, бесплатно переданные ему городом, и средства от продажи квартир в домах, изначально предназначенных для расселения жильцов хрущёвок по программе реновации, в оффшорные зоны – на Кипр и на Сейшелы.
Так что, много ли проиграл застройщик в 13-м судебном процессе, была ли это тактическая ошибка или стратегический ход, ещё вопрос. Бизнес не досчитался, по его оценке, двух миллионов. А вот каких сумм не досчитается город и жители в случае отмены программы реновации – это лишь предстоит выяснить.
