Можно ли доверять страховым брокерам? Как клиентам уберечься от брокеров-мошенников или просто ошибок посредников? Эти вопросы были основными на круглом столе на тему взаимодействия между страховщиками, брокерами и страхователями, состоявшемся недавно в информационном агентстве ABNews.
Брокер – посредник между страховой фирмой и её клиентом, хорошо знающий рынок страхования и умеющий найти среди всего многообразия предлагаемых вариантов именно тот, который нужен заказчику. По мнению заместителя директора филиала по партнерским продажам Северо-Западной дирекции РОСНО Владислава Анисимова, брокерские услуги удобны, поскольку делают возможным общение клиента и страховых компаний «через одно окно». К примеру, свои страховые брокеры есть практически у каждого крупного автосалона. Тем не менее, так называемые «свободные» брокеры зачастую становятся источником проблем из-за отсутствия контроля процессов внутри брокерской конторы и сбоев в обмене информацией между клиентом, брокером и страховой компанией.
В качестве решения этих проблем участники дискуссии предлагали самые разные меры. К примеру, страховым компаниям предлагалось договориться о единых штрафных санкциях по отношению к недобросовестным брокерам. Участники дискуссии уточнили, что сейчас штрафные санкции страховыми компаниями практически не применяются, иначе брокеры относились бы более ответственно и к оформлению необходимых документов, и к срокам оплаты.
Генеральный директор ООО "Бриг" Инна Чехович подчеркнула, что сейчас нет четкого понимания, кто действует на рынке. Компании, уличённые в мошенничестве, закрываются, а назавтра их бывшие собственники регистрируют новые ООО, и страховщики заключают с ними новые договоры. По словам заместителя руководителя инспекции страхового надзора по Северо-Западу Павла Молчанова, страховые компании в большей степени заинтересованы в присутствии брокеров, чем брокеры – в присутствии страхователей.
Лицензирование брокерских услуг и в целом взаимоотношения страховой компании, брокера и клиента нужно перенести на законодательный уровень – считает руководитель Северо-Западного федерального округа Российского Союза Павел Щербаков. Но это, по его мнению, очень трудоёмкий процесс, которому препятствуют как страховые компании, так и брокеры. Инна Чехович тоже говорила о необходимости создания законодательной базы, определяющей обязанности брокера, его действия в процессе страхования. Основная причина недобросовестности брокеров и неэффективности лицензирования посреднических услуг, по её словам, в том, что нет закона, запрещающего работать без лицензии. Такой закон должен закрепить обязанности брокера и его действия в процессе страхования.
Первый заместитель директора филиала ООО "Росгосстрах" в Санкт-Петербурге и Ленинградской области Татьяна Никитина отметила, что проблема лицензирования обсуждалась еще в апреле этого года, но ситуация пока не изменилась к лучшему. Прошедшее лето показало, что пожары нанесли огромный ущерб имуществу граждан, и теперь появились перспективы введения новых видов обязательного страхования. Татьяна Никитина утверждала, что мы можем получить на рынке новый "эффект ОСАГО", что дополнительно обострит угрозу расширения "брокерской опухоли". По её мнению, для решения этой проблемы необходимы и меры государственного регулирования, и самостоятельные действия профессионального страхового сообщества.
