Министерство регионального развития требует через суд с Альфа-банка $19 млн и $9 млн — с корпорации «Трансстрой» Олега Дерипаски за то, что корпорация задержала сдачу второй очереди дамбы, защищающей Петербург от наводнений. Когда в октябре прошлого года премьер Владимир Путин в день своего рождения торжественно открывал судоходство через дамбу, тогдашний глава Минрегионразвития Дмитрий Козак называл объект «дамбой имени Путина», а его подчиненные рапортовали о том, что строительство идет с опережением графика.
ЗАО «Инжиниринговая корпорация «Трансстрой»» («Инжтрансстрой»; входит в «Трансстрой» Олега Дерипаски) в октябре 2005 года заключило с Росстроем контракт стоимостью 4,7 млрд руб. на строительство в Санкт-Петербурге второй очереди комплекса защитных сооружений (КЗС) от наводнений. Одновременно дамба должна стать составной частью Кольцевой автодороги (общая стоимость проекта — 85,2 млрд руб.). После ликвидации Росстроя в мае 2008 года правопреемником федерального агентства стало Минрегионразвития. В ноябре 2007 года Альфа-банк выдал «Инжтрансстрою» банковскую гарантию на $19 млн, которая должна была отойти министерству в случае невыполнения подрядчиком условий контракта.
В октябре 2008 года, в день рождения Владимира Путина, в присутствии самого премьер-министра через КЗС было торжественно открыто судоходство. Тогдашний глава Минрегионразвития Дмитрий Козак заявлял «Ъ», что «это действительно дамба имени Путина» и что заказчики подарили премьеру на день рождения «макет этого сооружения». Тогда представители министерства рассказывали премьеру, что работы по сооружению дамбы идут с опережением графика.
Но на прошлой неделе выяснилось, что министерство не считает дамбу готовым объектом. Директор юридического департамента Альфа-банка Михаил Гришин рассказал «Ъ», что Минрегионразвития потребовало от Альфа-банка погасить банковскую гарантию на $19 млн. Соответствующий иск от министерства к банку зарегистрирован 4 февраля на сайте арбитражного суда Москвы (дело NА40-10992/09).
Проект по строительству КЗС был разработан в 1977 году. К 1995 году было выполнено около 70% работ. После чего проект был заморожен до 2005 года. Через год была принята федеральная программа по завершению строительства КЗС. С 2006 года проект курирует Владимир Коган, который к этому момент продал ВТБ свою долю в Промстройбанке. По дамбе проходит участок КАД, соединяющий между собой северную и южную часть Санкт-Петербурга и остров Котлин. Общая протяженность комплекса — 25,4 км. Срок сдачи всего комплекса — 2011 год.
В Минрегионе «Ъ» сообщили, что в соответствии с контрактом «Инжтрансстрой» обязался выполнить работы по строительству судопропускного сооружения С-2 и подъемного моста до 18 марта 2008 года. Министерство считает, что к указанной дате подрядчик не завершил выполнение всех работ по контракту. В частности, по состоянию на 22 января 2009 года не приняты подведомственной Минрегиону дирекцией КЗС работы на общую сумму $2,12 млн. «По истечении срока контракта подрядчик не оформил всю исполнительную документацию, что не позволило дирекции КЗС ввести объект в эксплуатацию»,— говорит директор Фонда инвестиционных строительных проектов (ФИСП; выступает финансовым агентом проекта КЗС) Алексей Васильев. В пресс-службе «Инжтрансстроя» настаивают, что все основные работы выполнены в полном объеме. Но заминка, по версии «Инжтрасстроя» возникла из-за того, что в марте 2008 года Минрегион предписал подрядчику приостановить работы для инвентаризации строящихся в рамках КЗС объектов. «Минрегион так и не представил документы, подтверждающие возникновение у него убытков в такой крупной сумме»,— говорит господин Гришин из Альфа-банка.
Государство не полностью расплатилось с «Инжтрансстроем» по контракту. Задержки по оплате со стороны заказчика начались после того, как проект стал курировать директор департамента капитальных вложений Минрегионразвития Владимир Коган (курирует работы по завершению строительства КЗС), экс-совладелец Промстройбанка и бывший замглавы Росстроя. «Он начал с ревизии всех проведенных до него тендеров и заключенных по ним контрактов»,— добавляет Алексей Васильев из ФИСП. По его словам, из $190 млн (сумма контракта с «Инжтрансстроем») подрядчику было выплачено около $182 млн руб., оставшиеся $8 млн подрядчик не получил из-за отказа дирекции КЗС подписать акт приемки.
