Арбитражный суд Москвы взыскал с металлургической компании «Мечел» и пяти ее дочерних структур $1,2 млн и около 560 тыс. руб. по иску Сбербанка, сообщает РИА «Новости».
Банк требовал взыскать задолженность по договору невозобновляемой кредитной линии от 9 октября 2012 года, по которому денежные средства в размере около 1,5 млрд руб. были предоставлены заемщику ОАО «Угольная компания «Южный Кузбасс». Остальные ответчики — ОАО «Мечел», ОАО «Мечел-Майнинг», ОАО «ХК «Якутуголь», ООО «Братский завод ферросплавов» и ООО «Мечел-транс» — выступили поручителями.
Тогда же стороны заключили соглашение о новации, по условиям которого при достижении курса 50 руб. за доллар заемщик должен выплачивать кредит в долларах, но из расчета 30 руб. за доллар. Банк в этом иске потребовал взыскания долга по процентам за период с 29 сентября 2014 года по 28 марта 2015 года в размере около $1,2 млн и неустойки.
В свою очередь «Южный Кузбасс» заявил встречный иск о признании недействительным соглашения о новации, поскольку при его заключении банк злоупотребил правом.
Арбитраж Москвы в среду полностью удовлетворил иск Сбербанка и отклонил встречный иск «Южного Кузбасса». «Дочки» «Мечела» могут в течение месяца подать апелляционные жалобы.
Ранее сообщалось, что Сбербанк не исключил продажи 70% долга «Мечела».
