Минпромторг и Федеральная антимонопольная служба (ФАС) не смогли согласовать суммы штрафов за нарушения обязанностей сетей и поставщиков, которые прописаны в уже вступившем в силу законе о торговле. Об этом пишет газета "Коммерсант".
ФАС подготовила поправки в Кодекс об административных правонарушениях, которые устанавливают ответственность за нарушение 9 статьи закона о торговле. В данной статье, регулирующей права и обязанности поставщиков и сетей, содержатся, как указывает газета "Ведомости", "наиболее чувствительные для ритейлеров ограничения". Это, к примеру, жесткие сроки оплаты товара, обязательство раскрывать условия договоров и другие нормы.
Антимонопольная служба предложила ввести предельный размер штрафа для торговых сетей в размере миллиона рублей. Минпромторг, напротив, предлагает ограничить штрафы отметкой в 300 тысяч рублей. Согласовать поправки стороны так и не сумели, и законопроект был отправлен в Минюст с указанием противоречий двух ведомств.
Ранее также выяснилось, что ФАС не может рассчитать доли торговых сетей на региональных и муниципальных рынках, поскольку в бюджет Росстата не заложена необходимая для сбора подобной статистики сумма.
С критикой закона о торговле, который в правительстве готовили более пяти лет, ранее выступали как торговые сети, так и известные отечественные экономисты. По их мнению, закон будет препятствовать конкуренции на рынке и развитию торговли.
