Заседания в Куйбышевском суде по делу Барсукова проходят уже по заданному стандарту. Большинство свидетелей регулярно не являются. Явившиеся стараются быть как можно лаконичнее. Сторону обвинения краткость показаний категорически не устраивает. Оглашаются другие показания – данные на предварительном следствии двенадцать лет назад. И тогда в зале суда звучат чуть ли не шаги истории…
На вчерашнем заседании выступили трое свидетелей. Первым был Владимир Малашевский. В 2006 году он работал сантехником в ОАО «Услуга». Эта фирма, по версии следствия, стала одной из жертв «организованного преступного сообщества», в создании которого и обвиняется Владимир Барсуков (Кумарин) по данному процессу. Второй подсудимый – Вячеслав Дроков. Ещё с семерых обвинения сняты. Уголовные дела по конкретным преступным эпизодам – в том числе «рейдерскому захвату» той самой «Услуги» – закрыты за давностью лет.
Но суд идёт. Преступление, которое он призван покарать, заключается в создании «сообщества». Как такового. «Законным людям не подобает объединяться в товарищества. Это получается скопом, незаконно», – внушал один комсомольский инструктор тридцать лет назад. В том и суть 210-й статьи УК РФ.
Вернёмся к ходу заседания. Свидетелю Малашевскому предложили рассказать о захвате предприятия, где он был акционером и сантехником. Владимир Борисович вспомнил: действительно, слышал от директора нечто подобное. В 2006 году кто-то попытался сменить в фирме собственника. И даже переименовал ОАО «Услуга» в ООО «Сервис». Привёл и некоторые детали: этому поспособствовали сотрудники Межрайонной инспекции ФНС N 15. Знаменитая в Петербурге «пятнадцатая налоговая» прославилась громким процессом 2010 года: четверо сотрудников были осуждены за должностные подлоги – две женщины условно, двое мужчин реально. Среди вменённых эпизодов было и переименование «Услуги» в «Сервис».
Но вопрос-то к Малашевскому, прямо говоря, не об этом. Обвинению нужны имена обвиняемых. Между тем, ни о Барсукове, ни о Дрокове свидетель не говорит ни слова. Тогда обвинитель – подполковник юстиции Ларин – ходатайствует об оглашении показаний на предварительном следствии. Защита в лице адвоката Чеботарёва возражает. Причём в довольно откровенной форме: «Что ему тогда в уста вложили – это вопрос особый».
Ходатайство, однако, принимается. Показания, данные в марте 2006-го, зачитаны. «Вложили» тогда немало. В этой связи вопрос свидетелю Малашевскому задаёт подсудимый Дроков: «Вам директор всё подробно докладывал? Или вы в основном по слухам ситуацию знали». Прямого ответа не звучит, но больше в том смысле, что – по слухам. На том свидетель свободен.
Следующий на трибуне – юрист Павел Лукин. («Привет, Паша», – вежливо здороваются обвиняемые. Свидетель тоже явно обрадован.) Обвинение интересуется помнит ли он обстоятельства смены собственника неких помещений. «Смутно», – отвечает Лукин. «Вытащите из памяти», – советует Ларин. Вытаскивается немногое.
С этим помогает Дроков, которому тоже предоставляется право задать вопрос: «А не было такого, чтобы на следствии давили? Чтобы показаний требовали на меня, на Барсукова?» Тут свидетелю есть что вспомнить: «Ну, это как всегда. Предлагали дать показания». Уточняющий вопрос вопрос задаёт Владимир Барсуков: кто именно? Разговор принимает нежелательный для обвинения оборот. Вслед за Ириной Доценко могут возникнуть и другие имена. Вплоть до Михаила Максименко, также занимавшегося «петербурским рейдерством», а ныне осуждённого за коррупцию.
Подполковник Ларин заявляет прежнее ходатайство – зачитать показания Лукина 2006 года. Но судья Королёв на этот раз ходатайство отклоняет. Причина отказа сугубо процессуальна, но достаточно серьёзна: те показания Лукин давал в качестве обвиняемого, а ныне выступает как свидетель. Тогда можно было прямо: скажете – выйдете, промолчите – сядете. Теперь так не положено. Лукин свободен и покидает заседание.
Третьим допрашивают свидетеля Андрея Мантели. Его судьба отчасти похожа на лукинскую: он тоже получил в те далёкие годы реальный срок. Тоже не по 210-й, а «всего лишь» по 159-й. С подачи Валерия Асташко, осуждённого за рейдерство в 2012 году. Тот предложил ему $3 тысячи за паспорт, на который должны были оформиться земельные участки. Паспорт Мантели дал, денег не получил (в отличие от срока). Характерная бизнес-история, что и говорить.
Но опять же: Барсукова и Дрокова вспоминать повода не нашлось. И со старыми показаниями то же. Судья отклоняет ходатайство по прежнему основанию: сказанное обвиняемым в преддверии срока трудно рассматривать как объективные показания свидетеля. Подсудимый Дроков интересуется у Мантели, за что его осудили. Ответ: «Не помню». Понятно, не вчера же это было. А давление имело место? В ответ – вежливое, но выразительное молчание.
Весь этот подсчёт взаимных «услуг» характеризует не только уровень доказательной базы обвинения в конкретном уголовном деле. Провал на этом направлении был очевиден с самого начала. Недаром судья Дондик вообще отказался от рассмотрения. Удивительным образом, на очень частных эпизодах, раскрывается история противостояния силового чиновничества и нового бизнеса. А заодно – пока «по касательной» – история силовой коррупции. Недаром еженедельные заседания оказываются столь кратковременными.
