В России в первый раз вынесен приговор за «организацию преступного сообщества лицом, занимающим высшее положение в преступной иерархии». Такой приговор получил «вор в законе» Мамука Гальский (Мамука Чкадуа). Об этом сообщил замглавы Управления по борьбе с организованной преступностью ГУР МВД Андрей Гусенко, передает РИА Новости.
Ранее СМИ предполагали, что первым осужденным по новому составу статьи 210 УК будет Захарий Калашов, также известный как Шакро Молодой, однако его дело еще не передали в суд.
Таким образом, первым осужденным с такой формулировкой обвинения стал «вор в законе» Мамука Гальский. Вместе с ним к различным срокам лишения свободы также приговорили 20 активных участников организованного преступного сообщества. Приговор в отношении вора в законе был вынесен судебной коллегией Алтайского краевого суда еще в конце апреля.
«В конце апреля этого года впервые в судебной практике был вынесен приговор по части 4 статьи 210 УК РФ, то есть по факту организации преступного сообщества лицом, занимающим высшее положение в преступной иерархии. Так называемый вор в законе Мамука Чкадуа, уголовная кличка Мамука Гальский, уроженец Абхазии, обвиняемый, в том числе, в вымогательствах и убийствах, судебной коллегией Алтайского краевого суда осуждён на 17 лет колонии строгого режима», — приводит слова Гусенко журнал МВД «Полиция России».
«Данный приговор создает прецедент для дальнейшего рассмотрения подобных дел в судах», — подчеркнул Гусенко.
Также, по его словам, по новому составу статьи привлекли к уголовной ответственности «вора в законе» Юрия Пичугина — лидера преступного сообщества, участники которого совершали тяжкие и особо тяжкие преступления в Северо-Западном и Центральном федеральных округах.
Часть 4 статьи 210 УК предполагает наказание от 15 лет заключения до пожизненного срока.
